NMIMS Centre for Distance and Online Education (“NCDOE”, “University”, “we”, “our”, or “us”) values the trust placed in us by prospective students, applicants, students, alumni, faculty, staff, visitors, and other stakeholders interacting with our digital platforms and institutional services. This Privacy Policy explains how information may be collected, processed, stored, used, disclosed, transferred, retained, and protected in connection with NCDOE websites, applications, enquiry forms, learning platforms, communication systems, academic processes, student support services, admissions operations, and related institutional activities.

By accessing, browsing, registering on, submitting information to, or using any NCDOE platform, service, application, communication channel, or enquiry form, users acknowledge that they have read, understood, and agreed to the terms of this Privacy Policy.

This Privacy Policy applies to all users interacting with NCDOE systems, including prospective students, applicants, students, alumni, parents or guardians, faculty, staff, corporate participants, vendors, recruitment partners, and visitors. This Policy applies only to websites, systems, applications, and services owned, operated, managed, or officially authorized by NCDOE. External websites, platforms, or applications linked through NCDOE systems may be governed by their own privacy practices and policies.

NCDOE may collect information including personal details such as name, address, email address, mobile number, date of birth, gender, nationality, educational qualifications, academic records, professional details, employment information, payment details, photographs, identity verification documents, communication records, enquiry information, counseling interactions, examination-related records, and any other information voluntarily submitted by users.

NCDOE systems may also automatically collect technical and usage-related information including IP addresses, browser type, device information, operating system details, session information, login activity, cookies, LMS usage information, website interaction data, analytics information, clickstream behaviour, geographic indicators, and system logs for operational, security, analytical, academic, administrative, and service improvement purposes.

Information may additionally be received from authorized partners, affiliates, social media platforms, recruitment agencies, payment providers, analytics providers, technology partners, or publicly available sources where permitted under applicable laws.

Information collected by NCDOE may be used for admissions processing, lead management, counseling, academic delivery, examinations, assessments, certification, student support services, alumni engagement, placements, payment processing, analytics, research, audits, quality assurance, operational management, cybersecurity, fraud prevention, grievance handling, communication, regulatory compliance, institutional planning, service improvement, and other legitimate academic, administrative, operational, legal, or institutional purposes.

NCDOE may also use information to personalize communication, improve user experience, evaluate engagement patterns, understand service usage trends, improve academic and operational effectiveness, and develop or enhance institutional services, systems, and digital infrastructure.

By submitting any enquiry form, registration form, application, or contact information to NCDOE, users expressly authorize NCDOE, its representatives, affiliates, authorized partners, service providers, and agents to communicate through phone calls, SMS, email, WhatsApp, online messaging platforms, notifications, or other communication channels regarding admissions, counseling, academic programs, events, support services, payment reminders, promotional campaigns, surveys, institutional engagement activities, and related services.

Such authorization shall apply even if the contact number may be registered under DND or NCPR services, to the extent permitted under applicable laws and regulations. Users may opt out of non-essential promotional communications through officially designated mechanisms. However, NCDOE may continue to send operational, transactional, academic, examination-related, legal, compliance, security, or service-related communications where necessary.

NCDOE platforms may use cookies, web beacons, pixels, analytics tools, session identifiers, and similar tracking technologies to improve platform functionality, personalize user experience, maintain session continuity, enhance security, measure campaign effectiveness, analyse user behaviour, optimize services, and support institutional analytics and operational management.

Users may configure browser settings to restrict or disable cookies; however, certain functionalities or services may become unavailable or impaired as a result.

NCDOE may engage third-party service providers, cloud hosting providers, communication platforms, CRM systems, analytics providers, payment gateways, LMS providers, examination systems, proctoring tools, marketing agencies, recruitment partners, and other operational or technology partners in connection with institutional activities and services.

Information may be shared with such entities where reasonably necessary for academic, administrative, operational, legal, compliance, financial, security, marketing, placement, or institutional purposes. While NCDOE exercises reasonable diligence in selecting such providers, NCDOE shall not be responsible for the independent acts, omissions, security practices, service standards, policies, or failures of third-party platforms or services not directly controlled by the University.

NCDOE may disclose information to affiliated institutions, academic partners, service providers, auditors, accreditation agencies, payment processors, financial institutions, recruiters, placement partners, government authorities, regulators, courts, law enforcement agencies, or other authorized entities where reasonably necessary for academic, operational, legal, financial, disciplinary, regulatory, security, administrative, compliance, placement, or institutional purposes.

NCDOE may additionally disclose information where such disclosure is necessary to enforce institutional policies, investigate misconduct, prevent fraud, respond to legal processes, protect institutional systems or property, defend legal claims, ensure cybersecurity, or safeguard the rights, safety, reputation, operations, or legitimate interests of the University and its stakeholders.

NCDOE does not sell personal information as an independent commercial activity.

NCDOE may retain records, communications, transaction data, enquiry information, academic records, analytics, logs, recordings, and operational metadata for such duration as deemed necessary for academic continuity, institutional administration, legal defense, audits, analytics, dispute resolution, cybersecurity, archival purposes, operational requirements, regulatory compliance, or enforcement of institutional rights and policies.

Residual copies of information may continue to remain within backup systems, archives, or security logs for a reasonable duration even after deletion or closure requests.

NCDOE implements reasonable technical, administrative, organizational, and security safeguards intended to protect information against unauthorized access, misuse, alteration, disclosure, destruction, or loss. Such safeguards may include encryption, firewalls, access restrictions, authentication controls, monitoring systems, audit mechanisms, role-based access controls, and periodic security reviews.

However, no internet-based platform, communication channel, cloud infrastructure, electronic transmission, or digital storage mechanism can be guaranteed to be completely secure, uninterrupted, error-free, or immune from cyber threats or technical failures. Users acknowledge and accept the inherent risks associated with internet usage, online systems, and digital communications.

Users are responsible for maintaining the confidentiality of their credentials, safeguarding their devices and accounts, ensuring the accuracy of submitted information, avoiding unauthorized sharing of institutional content or credentials, and complying with applicable institutional rules, policies, and laws.

NCDOE shall not be responsible for losses, misuse, or unauthorized activities arising from user negligence, credential sharing, compromised devices, malware infections, unauthorized account access caused by user actions, or failure to maintain reasonable security precautions.

NCDOE platforms may contain links to external websites, applications, embedded content, social media platforms, or third-party services that are not owned or controlled by the University. NCDOE shall not be responsible for the content, availability, security practices, or privacy policies of such external platforms, and users access such services at their own discretion and risk.

Nothing contained in this Privacy Policy shall be interpreted as creating warranties, guarantees, uninterrupted service obligations, fiduciary duties, or contractual assurances beyond those expressly required under applicable law.

To the maximum extent permissible under applicable law, NCDOE shall not be liable for indirect, incidental, consequential, reputational, punitive, or special damages arising from cyber incidents, technical failures, third-party breaches, service disruptions, unauthorized access, internet failures, malware, hacking attempts, force majeure events, or circumstances beyond the reasonable control of the University.

NCDOE reserves the right to modify, revise, update, suspend, or replace this Privacy Policy at any time without prior notice. Updated versions shall become effective upon publication on official platforms. Continued use of NCDOE systems, services, websites, or applications after such publication shall constitute acceptance of the revised Policy.

This Privacy Policy shall be governed in accordance with the laws of India. Any disputes arising in connection with this Privacy Policy shall be subject to the exclusive jurisdiction of the courts located in Mumbai, Maharashtra, India.
